Jurisdiction
Section 194(1): Proceedings for an offence against this Act or the regulations are to be dealt with summarily before the Local Court.
Section 194(2): If an offence against the Act is an indictable offence, the Local Court may nevertheless hear and determine the proceedings if the court is satisfied that it is proper to do so and the defendant and prosecutor consent.
Section 194(3): If, in accordance with s 194(2) the Local Court convicts a person the maximum penalty the court may impose is:
- (a)

in the case of an individual — the smaller of—
- (i)

a fine of 50 pu and/or 2 yrs imprisonment
- (ii)
-
the maximum penalty applicable for the offence when committed by an individual, or
- (b)
-
in the case of a corporation — the smaller of—
- (i)
-
a fine of 100 pu, or
- (ii)
-
the maximum penalty applicable for the offence when committed by a corporation.
Section 194(4): Proceedings for an alleged offence against ss 54, 55, 97H, 147, 148(c), 150, 159, 176, 177, 178 and 180 the Act may be commenced within 3 years after the commission of the alleged offence.
Corporations
Section 193: The maximum penalty applicable to a corporation convicted of an offence against this Act or the regulations is (except in so far as other provision is made by section 194) double the pecuniary penalty otherwise applying to the offence.
