Update 155 amends the Bench Book to update and revise various chapters and incorporate recent legislative developments. The following chapters have been revised:
have been updated to incorporate new s 28B of the Bail Act, inserted by the Bail and Other Legislation Amendment (Domestic Violence) Act 2024 and Crimes (Domestic and Personal Violence) and Other Legislation Amendment Act 2024, and the Bail Regulation 2021 amended by the Bail Amendment (Electronic Monitoring) Regulation 2024.
Section 28B, which commenced on 11 October 2024, provides an electronic monitoring requirement must be imposed when bail is granted in relation to a serious domestic violence offence unless sufficient reasons exist, in the interests of justice, to justify not imposing the condition.
The Index, Table of Cases and Table of Statutes have been updated to Update 155.
